Terms of Sales

ARTICLE 1: GENERAL

1.1 OBJECTS

SAS Cocorico & Co is a simplified joint-stock company with a capital of 35,420 euros, whose head office is located at 20 Passage de la Luciline, 76000 Rouen, registered in the Trade and Companies Register of Rouen under number B 820 815 249 .
These general conditions of sale govern all relations between SAS Cocorico & Co (hereinafter referred to as "COCORICO AND CO") and the customers of its website "www.lecoqtoque.com" (hereinafter referred to as "THE COQ TOQUE”) which allows you to place orders for products intended for home delivery.
Full adherence to the general conditions of sale, developed below in nineteen articles is necessary and essential to be able to place an order.
Consequently, the purchaser may not rely on an enforceability on any clause, the placing of an order acting as an express acceptance of these.
They will therefore govern relations between COCORICO AND CO and any non-commercial adult natural person, on the occasion of the sale of products offered on LE COQ TOQUE , for delivery in France and in all countries of the European Union.
The buyer will be referred to in this document as “you”.

1.2 FULL CUSTOMER CAPABILITY

You acknowledge that you have full capacity to commit to these general conditions of sale when you place orders on the LE COQ TOQUE website.
In accordance with article L.3342-1 of the Public Health Code and law n°2009-879 of July 21, 2009, the sale of alcohol to minors is prohibited. Anyone placing an order on the Site undertakes to have the legal capacity and age required on the date of the order.

1.3 IDENTIFIER AND CUSTOMER ACCOUNT

During the first order you choose and enter a username and password. A uniqueness check of the identifier is then carried out by the system. This strictly confidential password will be requested for each transaction.
You agree to take care of this identifier; you must immediately report any loss in writing to clear your liability.
If you lose or forget your password, you can click on a link "if you have forgotten your password" and enter your email address. You will receive a link by e-mail to reset a new password once your e-mail address is recognized.

1.4 MODIFICATION OF THE GENERAL CONDITIONS OF SALE

Given the possible evolutions of the LE COQ TOQUE website, COCORICO AND CO reserves the right to adapt or modify these general conditions of sale at any time. The new general conditions of sale will, if necessary, be brought to the attention of the customer for modification online and will only be applicable to sales made after the modification.

ARTICLE 2: PRODUCTS

The list and characteristics of the products offered by LE COQ TOQUE may be modified and adapted at any time to better meet your expectations and/or depending on available stocks.

Information relating to the products is accessible by clicking on the description or the photograph of the product. These indications are intended, without being exhaustive, to inform you as completely as possible about the essential characteristics of the products.
COCORICO AND CO provides the best work so that each information and each photograph is as faithful as possible, for the products as for the associated services. It is possible that the visitor's perception does not correspond 100% to the products, due to the digital presentation on the website.
The photographs, information, graphics or any other component of the LE COQ TOQUE site are indicative and do not bind COCORICO AND CO.

The products offered on LE COQ TOQUE comply with French legislation and the standards applicable in France.

The products are available at the prices and conditions offered as long as they are present on LE COQ TOQUE (within the limit of available stocks).

ARTICLE 3: GEOGRAPHICAL AREA

As of June 1, 2018, LE COQ TOQUE is available in French.
All products are shipped and delivered only in France.

ARTICLE 4: AVAILABILITY OF PRODUCTS AND SERVICES

LE COQ TOQUE is accessible 24 hours a day, 7 days a week, every day of the year. It is nevertheless possible that an interruption may occur, voluntary or involuntary on the part of COCORICO AND CO. COCORICO AND CO will in no way be liable for any damage resulting from this interruption, whatever its nature.

ARTICLE 5: PRICE OF PRODUCTS

The selling prices of the products marketed on LE COQ TOQUE are expressed in euros, all taxes included (TTC). They take into account the French VAT in force. Any change in the French VAT rate will be reflected immediately in our prices. Product prices may be changed at any time without notice by COCORICO AND CO.

ARTICLE 6: ORDERS

6.1 REGISTRATION AND VALIDATION OF ORDERS

Online orders can only be made through the LE COQ TOQUE website, which presents a selection of COCORICO AND CO products, and products from third-party suppliers. Orders made by mail or telephone are not taken into account.

In order to place an order on LE COQ TOQUE , please select each desired item to fill your basket. Once all the products are in the basket, you can confirm your order.

Once the order has been validated, COCORICO AND CO considers that the customer has read and accepted the General Conditions of Sale of the LE COQ TOQUE site.

The payment of the price of the products makes the order final subject to the application of article 4.3 below.

After placing an order, the customer will receive an e-mail confirming it. If the customer does not receive this confirmation email, it is possible that it is in spam. If the email is still not there, please contact customer service at the following address: info(at)lecoqtoque.com
The order is accepted by the company when it has acknowledged receipt.

COCORICO AND CO is not responsible for any error in entering the customer's e-mail address. The latter will therefore receive neither a confirmation message nor his order.

COCORICO AND CO reserves the right to suspend or cancel an order if there is a default / incident of payment (partial or complete) or an attempt at fraud on the website.

6.2 ORDER CANCELLATION CONDITIONS

In the case of perishable products, the withdrawal period of articles L 121-20 and following of the Consumer Code does not apply. However, you have the option of canceling your order under certain conditions.

The period within which you can cancel your order is set at 24 hours after payment has been made, provided that the order has not already been dispatched. Once the order has been dispatched, you can no longer cancel it.

After verification of compliance with this condition, you will be reimbursed by check or bank transfer within fifteen days of verification.

Exceptionally, an item advertised as available on our website may be unavailable after final registration of your order. In this case, you will receive a letter notifying you of the delivery time. You can then, if you wish, decide to cancel your order.

ARTICLE 7: PAYMENT

Online payment is made by credit card only.
To do this, choose your type of card (credit card, VISA, Mastercard, American Express, e-credit card), enter your card number, its expiry date and your cryptogram code (composed of the three digits located on the back of your credit card) then validate your data or click on "Cancellation - Return to the shop" to return to the previous page.
In order to provide you with the most reliable and secure service, we have chosen the BNP Paribas payment system. The entries are encrypted (SSL encryption) to circulate in complete security and confidentiality. No payment information is stored on our site. Your payment request is sent in real time to the BNP Paribas secure payment system: the bank ensures that your bank card is valid (no input error, no opposition), confirms the registration of your payment by giving you a transaction number or informing you that the transaction has been refused.
Your account is debited for the amount of your order.

ARTICLE 8: DELIVERY

COCORICO AND CO delivers its products and those of its third-party suppliers in France only and can, on request, deliver to any country.
The products are shipped with the delivery slip, to the delivery address indicated when you placed your order. Delivery cannot be made to hotels or PO boxes.
COCORICO AND CO indicates delivery times. These are indicative and correspond to the average order processing times, plus the delivery times noted by the carriers:

Delivery options:

  • Point Relais Colissimo delivery: processing and delivery time 5 to 7 working days.
  • Colissimo home delivery: processing and delivery time 5 to 7 working days.

In order for these deadlines to be respected, you must ensure that you have communicated exact and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

  • Orders are received from Monday to Friday (excluding public holidays).
  • Orders placed on Saturday and Sunday are processed on Monday or Tuesday depending on available stock.
  • During periods of high carrier activity (end of year holidays, summer, etc.), the delivery time may be extended.

COCORICO AND CO makes every effort to meet delivery deadlines. However, COCORICO AND CO cannot be held responsible for any delays in delivery due to a major holiday with high delivery traffic (Christmas, Easter, Mother's Day, etc.) or any case of force majeure.


ARTICLE 9: COMPLAINTS

COCORICO AND CO makes every effort to satisfy you as best as possible. In this context, if you have a complaint to make, you can send it by mail to the address below or directly via the "Contact us" section on our website www.lecoqtoque.com, specifying the order number concerned. .
If the product has not been delivered, for any reason other than force majeure or the aforementioned cases (absence of the recipient, incorrect information, etc.), the sale may be canceled and the buyer may obtain a refund of his price, to the exclusion of any other indemnity or damages.
We remind you that you benefit from the legal guarantee of conformity provided for in articles L211-4 and following of the consumer code and the legal guarantee relating to the consequences of defects or hidden defects provided for in articles 1641 and following of the civil code. Reimbursement will be made by check or by transfer.

ARTICLE 10: RETURNS

For health and safety reasons, the law does not allow returns on food products. COCORICO AND CO will not take back any package or product.

However, we will do our best to satisfy you (in the event of a damaged product, for example) by sending you replacement products.

ARTICLE 11: CUSTOMER FILE

The data collected by COCORICO AND CO on LE COQ TOQUE is intended for us and is necessary for the management of your order and our commercial relations. As a customer, you will receive our catalogs and commercial offers unless otherwise specified (right of opposition).
Some data is optional for order processing, it is up to you whether or not to fill in the field concerned.

In accordance with the Data Protection Act of January 6, 1978, you have, at any time, a right of access, rectification, and opposition to all of your personal data: by writing, by mail and by justifying of your identity, to SAS COCORICO AND CO, 20 Passage de la Luciline, 76000 Rouen.

ARTICLE 12: PROHIBITION OF OFF-NETWORK SALES

The products of COCORICO AND CO and our third-party suppliers are intended to be sold only through our distribution networks. Consequently, it is prohibited to purchase the products of COCORICO AND CO and our third-party suppliers for the purpose of their resale outside our networks, in particular on websites. Beyond an attack on our brands and the integrity of our products, such acts may be of a nature to engage the civil and, where appropriate, criminal liability of their perpetrators.

ARTICLE 13: INTELLECTUAL PROPERTY

All the elements present on LE COQ TOQUE , whether visual or sound, including the underlying technology, are protected by copyright, trademarks and patents. By connecting to the LE COQ TOQUE website, the customer is prohibited from copying or downloading all or part of its content, except with the prior and express authorization of COCORICO AND CO.


ARTICLE 14: CASE OF FORCE MAJEURE

COCORICO AND CO is exonerated from its liability, in all cases of force majeure, linked to irresistible, unforeseeable and external circumstances. Cases of force majeure are considered to be cases of recognized damage or bad weather, strikes by logistics service providers, or any other event likely to disrupt the proper circulation of goods and computer flows.

ARTICLE 15: APPLICABLE LAW AND DISPUTES

These General Conditions of Sale are subject to French law.
In the event of a dispute, an amicable solution will be sought first before any legal action. To this end, please contact our customer service department by post at the following address: SAS COCORICO AND CO, 20 passage de la luciline , 76000 Rouen . In the absence of an amicable solution, any legal action will be brought before the competent courts.

ARTICLE 17: RESPONSIBILITIES

The LE COQ TOQUE site distributes COCORICO AND CO products and products from third-party suppliers. With regard to the products of third-party suppliers present on the LE COQ TOQUE site, COCORICO AND CO is neither the manufacturer nor the designer and is therefore in no way responsible for any damage that may result from the use or consumption of products from third-party suppliers present on the LE COQ TOQUE site (whether the damage is bodily, material, immaterial, etc.).

If obligations have not been met but are attributable to a third party, a customer or the occurrence of an event that was not under the total control of COCORICO AND CO, the responsibility of COCORICO AND CO cannot be engaged.

SaS COCORICO AND CO declines all responsibility for damage (direct and indirect, foreseeable or unforeseeable) caused during the use of the LE COQ TOQUE website. In the event that the liability of SaS COCORICO AND CO were to be engaged because of damage suffered by the visitor, this would be limited to the height of the amount of the order.

Any claim must be filed by the user and victim of the damage within one month of the occurrence of the event.

ARTICLE 18. PRODUCT WARRANTIES

COCORICO AND CO guarantees its customers that all producers manufacture and package their products under strict French quality rules. All the products distributed by the LE COQ TOQUE website comply with the regulations in force in France.

On all products there is an optimal use-by date, or a maximum use-by date. COCORICO AND CO is not responsible for any problems that may arise during the consumption of a product with an outdated date, or if the customer has not respected the optimal storage conditions.

All the ingredients of the products are indicated: anyone with an allergy must take precautions before consuming.

ARTICLE 19. DEACTIVATION AND DELETION OF CUSTOMER ACCOUNT

COCORICO AND CO reserves the right to delete a customer account if it does not comply with the obligations subscribed to in these General Conditions of Sale, in the event of a payment incident or an action contrary to the interests of COCORICO AND CO, the issuance of false information when creating an account or placing an order.

COCORICO AND CO may suspend access to the account or delete it, depending on the seriousness of the actions.

Even if the customer creates a new account, COCORICO AND CO reserves the right to cancel any order from a customer with whom there is/would have been a dispute.
